Distance Contract

The seller of the goods and services offered on this website www.apkartcesim.lv is the association "Sporta klubs Ašais", registration number 50008134741, legal address Drabešu muižas pils, Drabeši, LV-4101, Latvia, account LV51HABA0551024210299 AS Swedbank, on the one hand, hereinafter referred to as the Seller, and person or entity placing the order, hereinafter referred to as the Customer, on the other hand, enters into the following Agreement:

The Seller undertakes to sell and deliver the goods and perform the services to the Customer in accordance with the Customer’s order.

Entry into force of the Agreement

The Agreement is valid as soon as the Customer has placed an order on the website and the Seller sent confirmation by e-mail. Orders and order confirmations are considered received when they may be accessed by who they are addressed to.

Ordering, delivery, and payment procedure

The Customer orders goods or services through this website, indicating the type and quantity of goods or services to be purchased. The Customer can make a payment using the payment tools built into the website or by paying the invoice prepared by the Seller and sent to the Customer by e-mail. The invoice is prepared electronically and is valid without a signature.

The Seller ensures the performance of the service according to the service description. The service is considered to be performed at the moment when the term of performance of the service has expired and the Customer has received the service provided in the description.

The Seller ensures the delivery of the goods to the delivery provider chosen by the Customer within 3 working days from the receipt of payment for the goods. The delivery fee is not included in the price of the product but will be included in the invoice.

The Seller has the right not to deliver the goods and not to provide the service if the Customer has not made the payment.

If the Seller is unable to perform the Agreement due to the lack of the goods ordered by the Customer or due to restrictions on the provision of the service, the Seller shall inform the Customer. In this case, the Seller may offer the Customer an equivalent product or service.

The Right of Withdrawal

The Customer has the right to withdraw from the product within 14 calendar days from the moment of receiving the product by sending a letter of withdrawal to the Seller.

The Customer is obliged to return the goods to the Seller within 7 days after sending the letter of withdrawal. All expenses that will be incurred in connection with the return of the goods to the Seller shall be paid by the Customer.

The Customer cannot use the right of withdrawal if:

· The ordered goods cannot be returned according to their nature, they are perishable or they can be used quickly.

· The ordered goods are made directly to the Customer by individual order.

· The Customer has opened the packaging of any data carrier.

According to Consumer Rights Protection Law of the Republic of Latvia the Seller reserves the right to refuse the Customer to use the right of withdrawal or to charge a compensation fee if the product is damaged by negligent handling of the product during use or without following the instructions, if the original packaging of the product is lost or its packaging is significantly damaged.

Data Processing

By entering the necessary information when placing an order, the Customer confirms that he has read and agrees that the data provided by him is used to enable the Seller to accept the Customer’s order and deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Customer agrees that notifications related to the processing of the order will be sent to the specified e-mail.

Duration of the Agreement

The Agreement enters into force at the moment, when the Customer has placed an order for goods and services and is valid until the parties fully fulfill their obligations to each other.

Dispute Resolution Procedure

Disputes arising out of this Agreement shall be settled amicably between the Customer and the Seller. If an agreement is not possible, then - in the law enforcement institutions of the Republic of Latvia in accordance with the procedures specified in the legal acts of the Republic of Latvia.
